Debts Not Discharged in Bankruptcy

  • Student loans (except in cases of "undue hardship")
  • Recent taxes (within three years of filing)
  • Child support or spousal support obligations
  • Divorce settlement obligations to a former spouse
  • Loans obtained under false pretenses

What Debts ARE Discharged?

Most unsecured debt is completely wiped out in a Chapter 7 bankruptcy. In a Chapter 13 bankruptcy, after you make the scheduled payments for three to five years, any remaining debts are discharged. The following debts are usually (but not always) dischargeable:

  • Credit card balances
  • Medical bills
  • Auto accident and negligence claims
  • Judgments
  • Personal loans
  • Business debts
  • Taxes and penalties dating back more than three years
