Can You File in Colorado? (And Should You?)

The minimum requirement to file for bankruptcy in Colorado is residency of three months.

For example, in a Chapter 7 bankruptcy, you must have lived in Colorado for 24 months to take the state's general exemptions (retirement funds, vehicles, furnishings, etc.). To claim the homestead exemption (up to $60,000 in home equity), you must have owned the home and lived in Colorado for 40 months.

  • If you have not lived here for 24 months, you can still file, but it may take more planning.
  • If you meet the minimum requirements but lack full residency status, I can help you decide whether you are better off taking the exemptions from your previous state or filing in Colorado under the federal list of exempt assets.
