Defense Against Bankruptcy Fraud Charges

John Turner - Colorado Springs Bankruptcy Litigation Lawyer

The idea behind filing for bankruptcy is to get protection from creditors who are demanding money you do not have. However, some creditors will take you to court, claiming that you committed fraud in avoiding repayment. Contact me immediately if you have been threatened with litigation, or if creditors have already taken action against you.

I am John Turner, Attorney at Law. My Colorado Springs, Colorado, practice is devoted entirely to representing individuals and small businesses in bankruptcy filings and bankruptcy litigation. I have the trial experience to defend you and protect your assets from lenders, credit card companies, and other creditors.

If your creditors resort to bankruptcy litigation to try to get you to pay, I am one of a few El Paso County bankruptcy lawyers who will defend you in court. In fact, other local lawyers often refer such cases to me.

Bankruptcy Litigation Defense

Many other bankruptcy attorneys are intimidated by bankruptcy litigation cases and will not take them on. I have run my own law office in Colorado Springs since 1994, focusing my practice exclusively on bankruptcy since 1999.

  • Home Foreclosure — If the holder of your mortgage has initiated foreclosure proceedings, we can stop this legal action immediately by filing for Chapter 13 bankruptcy. The lien holder can still take you to court to challenge the "automatic stay," but only if they have proof that you lied on your loan application or committed fraud in avoiding your mortgage payments. I will aggressively fight any attempts to take your home.
  • Fraud allegations — Most bankruptcy litigation revolves around accusations that the filer violated bankruptcy laws to avoid paying creditors what they owe. For example, purchases of luxury items, cash advances, or running up your credit cards in the few months before filing cannot be discharged, and can void your bankruptcy discharge all together. Other grounds for challenging your bankruptcy include repaying debts to select creditors "under the table," lying about residency to take the home equity exemption, concealing assets, or making other false claims about income or eligibility.

Creditors can seek to seize assets, garnish your wages, or place liens on your bank accounts or retirement funds. I leverage all my skills and experience to prevent these outcomes.

Avoiding Litigation

In over 20 years of bankruptcy practice, I have become adept at helping clients avoid creditor lawsuits by filing the bankruptcy properly in the first place. I can discuss how to clear up problems with your finances before filing your small business or consumer bankruptcy.
